ADU-permissive states.

Capsul's ADU and Designer Home models are compliant with ADU regulations in the states below. Other states often have municipal-level ADU rules — confirm at quote stage.

SB-9 + statewide ADU law. Typically up to 1,200 sq ft, often by-right with ministerial approval. 4-month review window mandatory. Capsul 6m or 12m fits standard CA lots.

Oregon
HB 2001. ADUs permitted in all single-family zones in cities over 25,000 population. No off-street parking required in many urban zones. Capsul ADU fits typical Oregon ADU envelope.
WA
Washington
HB 1337. ADUs by-right in cities and unincorporated urban growth areas. Maximum 24-foot height. Capsul ADU and Designer Home both compliant.
CO
Colorado
HB 24-1152. ADUs by-right in major metros from 2025. Owner-occupancy and parking minimums limited. Capsul fits standard suburban lots.
VT
Vermont
Act 47. ADUs permitted statewide. Maximum size 30% of primary dwelling or 900 sq ft. Capsul 6m ADU fits typical Vermont lots.
MA
Massachusetts
2024 ADU Law. ADUs by-right on lots zoned single-family, up to 900 sq ft, no owner-occupancy requirement. Capsul ADU fits.
NY
New York
ADU programs in NYC + Albany. Pre-approved ADU designs accepted in select municipalities. State-level legislation pending. Confirm by municipality.
TX
Texas
Municipal-level (Austin, Houston, Dallas have permissive ADU rules). No statewide ADU law yet. Capsul compatible with most permissive Texas municipalities.

United Kingdom · Permitted Development

Most Capsul UK installs don't need planning permission.

Under Permitted Development (PD) rights, secondary residential outbuildings — including modular units — can be installed without a full planning application, subject to size, height, and lot-coverage limits.

Single-storey outbuilding, eaves ≤2.5m, total height ≤4m (pitched) or 3m (flat), within curtilage of dwelling. Capsul 6m and 12m fit standard PD envelope.

Prior Approval
For larger installations or those near boundaries, prior approval from local authority required (usually 8–12 weeks). Capsul team confirms PA eligibility at quote stage.
FP
Full Planning
For new dwellings, change-of-use, or conservation/listed areas. Standard 8-week planning application. Capsul provides supporting documentation.
BR
Building Regulations
All Capsul UK installations comply with Building Regs Part A (structure) and Part L (energy). BOPAS-accredited — mortgageable with Nationwide, Halifax, Barclays.
Australia · Granny flat pathways

Granny flats via CDC — council-approved in weeks.

Most Australian states have streamlined secondary-dwelling (granny flat) regulations that allow Capsul to be approved via Complying Development Certificate (CDC) — typically 10–21 days, not the months a full Development Application requires.

State Environmental Planning Policy (Affordable Rental Housing) 2009. Up to 60 m² secondary dwelling on lots ≥450 m². CDC pathway. Capsul ADU and Designer Home both eligible.
VIC
Victoria
Class 1a Dependent Person's Unit regulations. Secondary dwellings permitted on most residential lots subject to size limits. BCA Class 1A required.
QLD
Queensland
Auxiliary Unit framework. Secondary dwellings permitted in most residential zones, typically up to 80 m². Capsul ADU compliant.
AU
All states
BCA Class 1A certification in Capsul's name. Insurable, mortgageable, fully compliant for permanent residential use under the National Construction Code.
